Do I have to pay the outgoings if I don’t believe they are correct?
- a tenant may withhold outgoings payments if the lessor does not provide the Outgoings Estimate and/or the Outgoings Statement when due and if not provided within a reasonable time-frame when requested by the tenant.
- The Statement must contain proof of payment of all invoices relating to charges included in recovered outgoings OR an audited statement of outgoings.
- The tenant is entitled to withhold outgoings payments where a dispute exists over the charges until the dispute is resolved
