Do I have to pay the outgoings if I don’t believe they are correct?
a tenant may withhold outgoings payments if the lessor does not provide the Outgoings Estimate and/or the Outgoings Statement when due and if not provided within a reasonable time-frame when requested by the tenant.
The Statement must contain proof of payment of all invoices relating to charges included in recovered outgoings OR an audited statement of outgoings.
The tenant is entitled to withhold outgoings payments where a dispute exists over the charges until the dispute is resolved
